Protect the Environment from pollution by corporations

Hello! My name is Phyllis Omido. I’m an Environmental Activist and the Founder of the Center For Justice Governance & Environmental Action. I’m based in Kilifi County in Kenya.

CJGEA filed an Environmental Class Action Suit in 2016 on behalf of the people of Owino Uhuru community to seek environmental justice through Judiciary and successfully obtained a judgement in the case. A state licensed lead smelter polluted a community by releasing toxic waste over a long period which in turn severely affected the environment and health of the residents. The ruling for this case was issued on 16th of July, 2020 and we recorded a huge win for the community. The court awarded the community Ksh 1.3 Billion in compensation and Ksh 700 Million was awarded to CJGEA for remediation.

This has brought us to another phase of the project which is appeal. CJGEAseeks partnership in implementing this. Appeal is a common process by law that respondents use if dissatisfied with the court’s ruling. We believe that the amount awarded to the community and the CJGEA in terms of compensation, remediation and costs caught the respondents off guard. We therefore need to prepare conclusively for this by developing a comprehensive strategy to counter the appeal.

Our budget is USD 100,000. We are getting 15,000 from the office of the high commission for human rights Nairobi. The rest we have to fundraise for it. The cost will cover legal fees, transport & flights for our legal team as well as court fees.
